Terms of Service

By accessing or using HappyPixel ("Service", "Platform", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

1. Service Description

HappyPixel provides AI-powered creative tools including:

  • AI image generation
  • AI writing assistance
  • AI organization and planning tools
  • AI conversational assistance

2. Eligibility

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you are at least 18 years of age.

3. Account Registration

  • You must provide accurate and complete information
  • You are responsible for maintaining account security
  • You are responsible for all activity under your account
  • One account per person
  • We reserve the right to refuse service to anyone

4. Credit System

4.1 Purchase and Use

  • Credits are virtual tokens used to generate content
  • Credits NEVER expire once purchased
  • Credits are NON-REFUNDABLE after purchase
  • Credit costs vary by feature and quality level

4.2 Pricing

One-Time Credit Packs:

  • Starter: $10 (500 credits)
  • Basic: $25 (1,250 credits)
  • Plus: $50 (2,500 credits)
  • Pro: $100 (5,000 credits)
  • Premium: $250 (12,500 credits)

Monthly Subscriptions:

  • Pro: $29/month (350 credits/month)
  • Creator: $79/month (1,200 credits/month)

4.3 Credit Costs

  • Image generation: 2-8 credits per image
  • AI Writer: 2-5 credits per generation
  • AI Organizer: 2-5 credits per task
  • AI Chat: 1-5 credits per message

5. Subscriptions

5.1 Billing

  • Subscriptions are billed monthly in advance
  • Subscription includes monthly credit allocation
  • Subscription credits reset monthly (use it or lose it)
  • Purchased credit packs carry over indefinitely

5.2 Cancellation

  • Cancel anytime via account settings or Stripe portal
  • Cancellation is effective at end of current billing period
  • No refunds for partial billing periods
  • Access continues until period end after cancellation

6. Content Ownership and License

6.1 Your Content

  • You retain ownership of all content you generate
  • You are solely responsible for your use of generated content
  • You must ensure your use complies with all applicable laws
  • You may use generated content for personal or commercial purposes

6.2 License You Grant Us

By using the Service, you grant us:

  • Right to store and display your content to provide the Service
  • Right to use your content (anonymized) for AI model training
  • Right to use your content for service improvement
  • Right to display your content in marketing (with explicit permission only)

7. Prohibited Uses

7.1 You May NOT Use HappyPixel To Create:

Illegal Content:

  • Child sexual abuse material (CSAM)
  • Content depicting minors in sexual or suggestive contexts
  • Content that violates any applicable laws
  • Content promoting illegal activities

Harmful Content:

  • Graphic violence, gore, or extreme cruelty
  • Content promoting terrorism or violent extremism
  • Hate speech targeting protected characteristics
  • Content promoting self-harm or suicide
  • Harassment, bullying, threats, or doxxing

Fraudulent Content:

  • Deepfakes of real people without their consent
  • Impersonation for fraudulent purposes
  • Misleading or deceptive content intended to defraud
  • Fake identification documents

Intellectual Property Violations:

  • Copyright infringement
  • Trademark infringement
  • Unauthorized use of others' intellectual property

8. Content Moderation

8.1 Automated Filtering

  • We use AI and keyword filtering to prevent prohibited content
  • Prompts violating our policies will be automatically rejected
  • Rejected prompts are logged for review
  • Repeated violations may result in account suspension

8.2 User Reporting

  • Users can report content that violates these Terms
  • Content receiving multiple reports may be automatically hidden
  • All reports are reviewed by our moderation team

9. Account Termination

We may suspend or terminate your account for:

  • Violation of these Terms
  • Illegal activity or content
  • Abusive behavior toward staff or other users
  • Excessive chargebacks or payment fraud
  • Attempting to circumvent security measures
  • Any use that harms the Service or other users

10. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE CONTINUOUS AVAILABILITY, ERROR-FREE OPERATION, OR SPECIFIC QUALITY OF AI OUTPUTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Dispute Resolution

These Terms are governed by the laws of the State of Washington, United States. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

12. Changes to Terms

  • We may modify these Terms at any time
  • We will notify you of material changes via email
  • Continued use after changes constitutes acceptance
